What is a cookie ?
A cookie is information placed on the hard drive of an Internet user by the server of the site he is visiting. It contains several data: the name of the server that deposited it, an identifier in the form of a unique number, possibly an expiration date. This information is sometimes stored on the computer in a simple text file that a server accesses to read and save information.
What are cookies used for?
Cookies have different functions. A cookie can allow the person who placed it to recognize an Internet user, from one visit to another, thanks to a unique identifier. Some cookies can also be used to store the contents of a shopping cart, others to save the language settings of a site, and still others to perform targeted advertising.
What is the applicable legal framework?
By amending Article 5(3) of Directive 2002/58/EC by adopting Directive 2009/136/EC, the European legislator laid down the principle that the storage of information on the equipment of a user or access to information already stored, should only be implemented with the prior consent of the user, unless these actions are strictly necessary for the provider for the delivery of a service expressly requested by the subscriber or user. Article 32-II of the law of January 6, 1978 takes up this principle.
